Police colluded in secret plan to blacklist 3,200 building workers!

IPCC tells lawyers representing victims it is likely that all special branches were involved in providing information

Police officers across the country supplied information on workers to a  blacklist operation run by Britain’s biggest construction companies, the police watchdog has told lawyers representing victims.

The Independent Police Complaints Commission has informed those affected that a Scotland Yard inquiry into police  collusion has identified that it is “likely that all special branches  were involved in providing information” that kept certain individuals  out of work.

The IPCC’s disclosure confirms suspicions voiced by the information commissioner’s office last year that the police had been involved in providing some of the information held on the files, as revealed by this newspaper.

The admission has been welcomed by campaigners for the 3,200 workers whose  names were on the blacklist that was run for construction companies as  “absolute evidence” of a conspiracy between the state and industry that  lasted for decades.

Dave Smith, an engineer who had a 36-page file under his name and was  repeatedly victimised for highlighting safety hazards on sites,  including the presence of asbestos, said he was delighted that the IPCC  had revealed “the truth”. He added: “For the past five years, when we  have been saying the police were involved, we were told we were talking  nonsense and it was a conspiracy theory. They wanted it to go away. Now  we have the absolute evidence and this is no longer about industrial  relations but is a major human rights scandal involving a conspiracy  between the police and the industry.”The blacklist, run by a company called the Consulting Association, funded by 40 major firms in the construction industry including Balfour Beatty and Sir Robert McAlpine, was discovered in  2009 after a raid by the information commissioner’s office. Since then,  the victims have fought to find out who was providing information  against them. The IPCC’s correspondence is regarded as a major  breakthrough.

However, the watchdog’s disclosure has been disputed by a subsequent letter to the victims’ solicitors. This was sent by a  recently appointed senior investigating officer for the inquiry into the activities of undercover police officers, known as Operation Herne.

In a letter, seen by the Observer, detective inspector Steve Craddock insists that the IPCC’s statement is incorrect and that he has seen “no conclusive evidence” that Scotland  Yard shared information with the blacklisters.

The IPCC is  standing by its correspondence, which it says was informed by  discussions with the Metropolitan Police and that “developments since  that … are a matter for the Metropolitan Police”.

In response, a spokesman for Craddock said Operation Herne’s investigating officer was “aware of the apparent contradiction and is looking into how that may  have arisen”. She added: “Operation Herne will report on the  ‘blacklisting’ matter to the Metropolitan Police commissioner in due  course.”

The developments come as the group fighting for justice  for the blacklisted workers has received confirmation of a meeting  between undercover police officers and those running the blacklist in  November 2008. The information commissioner’s officers have confirmed in a freedom of information response that they hold notes from a meeting  between the Consulting Association and officers from the police national extremism tactical co-ordination unit, which runs undercover officers.

The notes of the 2008 meeting are part of a haul of documents seized by the information commissioner’s office when it discovered the existence of  the secret blacklist during a raid on an office in Droitwich,  Worcestershire.

Sir Robert McAlpine, which was allegedly a major player in the  establishment and funding of the blacklist, is currently being sued in  the high court over an unlawful conspiracy to amass a database of information against thousands of people.

Last week, in a dramatic twist, eight major construction companies, including Sir Robert McAlpine, announced  that they would compensate some of the 3,213 workers whose names had been on a blacklist. A statement said: “The companies – Balfour Beatty, Carillion, Costain,  Kier, Laing O’Rourke, Sir Robert McAlpine, Skanska UK and Vinci – all  apologise for their involvement with the Consulting Association and the  impact that its database may have had on any individual construction  worker.”

Sean Curran, a solicitor representing 69 victims in the  high court, said he cautiously welcomed the announcement but raised  concerns over the involvement of the unions, which are also suspected of providing information to the blacklist operation in some cases. He  said: “We note that there has been reference to the consultation of  Ucatt and Unite in the formulation of the proposed compensation scheme.  We express serious concern about the involvement of those organisations.

“We have seen evidence that implicates Amicus (which evolved into Unite)  and Ucatt officials in the supply of negative commentary about the  suitability of their members for employment. That commentary frequently  made its way onto the Consulting Association database and was no doubt  one of the factors that led to denials of employment.

“It is also  worthy of note that those unions refused to support their members in  bringing a High Court claim so that they could seek redress for the  hardship that they suffered. Many of those that we represent are firm  that they object to Unite or Ucatt playing any part in negotiations with the relevant companies for these reasons.”

Claire Windsor,  solicitor for the victims in regard to the complaint over police  collusion, said her clients had lost any faith in the ability of the  police to investigate themselves and that the blacklist support group  was now calling for a judge-led independent inquiry into blacklisting.

Almost a year ago, during the G20 demonstration in central London. The police indiscriminately assaulted hundreds of people in an attempt to spark a riot. Hundreds were clubbed and assaulted. One person was murdered. Many others were attacked on their way home, up to half a mile from the demonstration. One, relatively tame incident, was caught on camara. The policeman involved was charged with assault. Today he was acquitted. Below is a Youtube video of the incident.  A riot squad officer who allegedly twice hit a female protester with a metal baton has been cleared of assaulting the woman.

A riot squad officer who hit a G20 protester twice with a metal baton has been cleared of assault. Metropolitan Police Sergeant Delroy Smellie, 47, clashed with Nicola Fisher outside the Bank of England last April.

The officer, a member of the controversial territorial support group, went on trial accused of assault by beating last week. He was cleared at City of Westminster Magistrates’ Court. But he could still face misconduct proceedings over the incident. Smellie, who was standing in the dock for the verdict, smiled widely and gave two thumbs up to his supporters as he was cleared.

District Judge Daphne Wickham said there was no evidence that his use of the baton was not approved, correct or measured. She said the officer had a “mere seven seconds” to act and other witness also feared for his safety. She said: “It was for the prosecution to prove this defendant was not acting in lawful self-defence. I have found the prosecution has failed in this respect and the defendant has raised the issue of lawful self-defence and as such is entitled to be acquitted.”

Ms Fisher, 36, ran in front of Smellie hurling abuse during a vigil to mark the death of Ian Tomlinson the previous evening. District Judge Wickham, who heard the case without a jury, watched video footage of the incident and looked at dozens of photographs. Nicholas Paul, of the Crown Prosecution Service, said Smellie lost his self-control because of Ms Fisher’s irritating, aggressive and confrontational actions. He said the officer was justified when he shouted at her, pushed her back and struck her with the back of his hand, knocking off her sunglasses.

But Mr Paul said the officer went too far when he struck Ms Fisher across the thigh with the extendable metal weapon, known as an asp. The clash attracted attention worldwide when amateur video footage of it was posted on the YouTube website. Ms Fisher, of Brighton, failed to attend the trial claiming she was suffering depression and did not want to be in the public spotlight again.

Zaytoun is a pioneering Fair Trade initiative selling Palestinian products in the UK and Ireland. We are a cooperative Community Interest Company and an World Fair Trade Association member. Zaytoun was established to support marginalized farming communities in Palestine. As a purpose beyond-profit company our primary objectives lie with the welfare of the producing communities. We invest in empowering farming communities and developing the agricultural infrastructure in Palestine. Since it inception in 2004 Zaytoun has imported more than 170, 000 litres of Palestinian olive oil into the UK which translates to more than £1.5 million reaching farmer cooperatives.

 We have worked closely with the Fairtrade Foundation since 2004 with the aim of certifying Palestinian Olive Oil. We are proud to announce that the first ever Fairtrade Certified product from Palestine was launched during Fairtrade Fortnight 2009.  Zaytoun’s range of Organic and Fairtrade Certified Olive Oil’s and Olives are the first Fairtrade Marked products in this category; this is a very exciting time for Zaytoun and the Palestinian farmer co-operatives that have been working to achieve Fairtrade status for 5 years.

We have invited Taysir Arabasi to the UK during Fairtrade Fortnight 2010. Taysir is Zaytoun’s Director in Palestine. He lives in Salfeet district which is an area highly dependent on olive cultivation and one which has seen much of its rich agricultural resources stolen through the construction of the illegal settlements. He has been working with community agricultural projects for the last ten years and has been instrumental in the grass roots campaigning against the building of the illegal annexation wall in the West Bank. Taysir is a passionate speaker about the rights of the small farmer and of the Palestinian people and an advocate of the power of fair trade.

This is positive story for change in Palestine with Fairtrade as the core message.

Treachery and stalinoid bourgeois liberalism in the SWP, Guildford.

I never thought for a minute that the young SUAC (Surrey United Anti-Capitalists) ‘comrade’ in the SWP took his party seriously. He always criticises ‘his’ party, it’s policies and methodology.

His great work in local environmental issues, housing and squatters’ rights- together with his tireless efforts promoting local, anti-capitalist unity- is a contradiction to the opportunism, sectarianism and theoretical vacuity of his party.

The recent expulsions and witch-hunts pervading the SWP have thus far passed Guildford by. Guildford is far enough from London to be out of the eye of the centralised SWP bureaucracy. The unprincipled political manoeuvrings within the SWP have given us in SUAC a great deal of amusement. The ‘crimes’ of those expelled or forced to resign appear petty compared to the Guildford membership’s autonomous disregard for their party’s policies. In Guildford, the two active SWP’ers put their efforts in to building anti-capitalist unity rather than their party’s sectarianism.    

The young comrade in question, Mr X agrees on the need to build up pluralistic Action Committees and Anti-Cap groups similar to our own –supported by a bottom up Anti-Capitalist Party. Being in the SWP however, he refuses to mention the Call for A New Anti-Capitalist Party because his party didn’t think of it first.

With this background in mind, I was shocked at the flagrant use of SWP tactics at this evenings SUAC meeting. Sneaked onto the agenda was Mr X’s proposal that before posters were distributed, they should be agreed by a meeting. This is something I’d insisted on for some time.

After some discussion the meeting decided that in cases where time is short, a minimum Coram of 4 people would be needed to approve a poster. During this debate it became evident that Mr X’s idea of ‘posters’ weren’t actually posters at all.

Mr X had raised objections to pictures on the SUAC Facebook group before. He had described them as “not respectable” and “giving SUAC a violent image”. Mr X thought he would be able to claim at a later date, an agreement regarding the approval of posters gave him a mandate to remove the pictures from the Facebook group. 

Mr X knows very well posters and Facebook pictures are quite different things – But he sought to conflate the two in order to avoid opposition to deleting the Facebook pictures. Mr X’s plan was to delete the Facebook pictures, performing a fate-a comply and claim afterwards the pictures were unapproved posters.

Such underhanded Stalinoid tactics will never succeed or be tolerated.
